Mission and Functions

Based on Law No. 99/2024, "On Inspection in the Republic of Albania," the General Inspectorate has been established as a central budgetary public institution, headquartered in Tirana, under the authority of the Prime Minister.

 

The mission of the General Inspectorate is to ensure the improvement and enhancement of the effectiveness and accountability in the conduct of inspection activities in the Republic of Albania.

I. The General Inspectorate has the following duties and responsibilities:

1) Approves and implements rules for documenting inspection activities, as well as reporting the activities of inspectorates;
2) Establishes a centralized database with individual profiles of inspected entities, aiming to improve and enhance the effectiveness of inspections, in compliance with the principles of this law;
3) Coordinates and monitors inspection activities;
4) Monitors the implementation of inspection policies and standards approved by the Inspection Board, as well as performance indicators in the field of inspection;
5) Reports to the Inspection Board on matters within its scope;
6) Provides opinions on any legislative and sub-legislative initiatives in the field of inspection;
7) Immediately initiates the procedure for establishing a disciplinary commission when violations of legal and sub-legal acts are identified during the performance of duties by inspectors at all levels;
8) Conducts the training, qualification, and certification of inspectors in coordination with central and local inspectorates;
9) Administers and utilizes the unique electronic inspection system, which serves for carrying out inspection activities, exchanging data between central and local inspectorates, and interfacing with the databases of other institutions;
10) Determines the types of technological tools for conducting inspection activities online;
11) Handles all information, complaints, and reports received from citizens or natural and legal persons regarding inspectors' activities, as well as directed inspection procedures, in accordance with the forms provided in the Code of Administrative Procedures, including complaints submitted through the intergovernmental interaction platform;
12) Approves any requests from central and local inspectorates for implementation, modification, or actions within the unique "e-Inspection" system;
13) Issues the inspector’s card for central inspectorates, while for local inspectorates it is issued by the mayor;
14) Establishes the rules for conducting inspection activities in exceptional cases, when the use of the electronic inspection system is not possible;
15) Supervises the on-site inspection procedures of central and local inspectorates.

II. The General Inspectorate has the following duties and responsibilities regarding central inspectorates:

1) Provides advisory opinions on annual programs and approves the monthly inspection programs prepared by the central inspectorates;
2) Coordinates and oversees the legality of inspection activities of central inspectorates;
3) Oversees the implementation of legal requirements by central inspectors for the planning, authorization, and execution of the inspection process;
4) Provides an opinion within 10 working days from the date of submission on the medium- and long-term budget programs prepared by the central inspectorates;
5) Carries out the procedures for establishing the recruitment and promotion commission for inspectors, the disciplinary commission, as well as the appeals commission for the final decision.

III. The General Inspectorate, regarding local inspectorates, has the following duties and responsibilities:

1) Coordinates and oversees the legality of inspection activities of local inspectorates, avoids overlapping of competencies with central inspectorates, supervises the procedures for recruitment, appeals, and dismissal of local inspectors, with the aim of ensuring compliance with inspection standards;
2) Oversees the implementation of legal requirements by local inspectors for the planning, authorization, and execution of the inspection process.

 

The General Inspectorate, in carrying out its functions, has the right to request all necessary information regarding the activities of central and local inspectorates, to inspect inspection files, as well as any other documents related to the planning and execution of administrative inspection procedures.

Vijojnë takimet intensive të Inspektorit të Përgjithshëm, z. Dashnor Sula, me Kryeinspektorët e inspektorateve shtetërore dhe drejtuesit  e trupave inspektuese aktuale, të cilat do ti nënshtrohen ristrukturimit dhe riorganizimit të trupave inspektuese në inspektorate qendrore, në zbatim të ligjit për inspektimin nr. 99/2024.

Gjatë takimeve u theksua rëndësia e angazhimit të plotë të të gjitha strukturave aktuale dhe ministrive përgjegjëse në realizimin dhe finalizimin me sukses të kësaj reforme.

Ristrukturimi i inspektorateve ndodhet në një fazë delikate dhe vendimtare dhe për këtë qëllim  Inspektorati i Përgjithshëm, përmes ngritjes së grupeve të posaçme të punës, do të ofrojë të gjithë asistencën e nevojshme për të garantuar mbarëvajtjen e këtij procesi, për krijimin e strukturave optimale në ushtrimin sa më efektiv dhe eficient të veprimtarisë inspektuese.

Gjithashtu, u bë e ditur iniciativa e Inspektorit të Përgjithshëm për ngritjen e një grupi paralel pune, i cili do të punojë për harmonizimin e strukturave dhe lidhjen e pagave, me pozicionet e punës, me funksione inspektimi, në të gjitha inspektoratet qendrore, me përfaqësues nga Inspektorati i Përgjithshëm, ministritë e linjës dhe strukturat aktuale inspektuese.

Një rëndësi të veçantë pati ritheksimi i faktit se, nuk do të ketë asnjë tolerim në lidhje me zbatimin rigoroz të detyrimeve që parashikon ligji nr. 99/2024 “Për inspektimin në Republikën e Shqipërisë”  për të gjitha strukturat inspektuese. Zbatimi i plotë dhe i njëtrajtshëm i këtij ligji do të garantojë kalimin drejt një sistemi inspektimi të standardizuar, të dixhitalizuar dhe të planifikuar mbi bazë të analizës së riskut, duke rritur transparencën, efikasitetin dhe barazinë në trajtimin e subjekteve të inspektimit
